These general terms and conditions apply when you as a consumer order via our website: www.evess.se. An agreement is drawn up between you and Evess AB, company identity number 559203-6866. Detailed contact information and other important information about Evess AB can be found on the contact us page. The terms and conditions only apply to consumers ordering via this website.
1.2
We follow the terms of the General Complaints Board (ARN).
1.3
You must be 18 or over to place an order with us. Under Swedish law, we do not accept credit purchases from people under the age of 18. In special cases, we reserve the right to refuse or change the order, for example if you have provided incorrect personal data or if you have not paid. Please also note that we cannot register a vehicle for people under the age of 18.
1.4
Sales are subject to stock availability and we accept no responsibility for any errors in images or text on this website, such as errors in a product description or in the technical specification, incorrect prices or price adjustments, such as changes in prices from suppliers or currency fluctuations or other incorrect information about whether or not a product is in stock or the number of products in stock. We have the right to correct errors and change or update the information at any time.

The information is protected by intellectual property and marketing law, which means that trademarks, product names, company names, images and graphics, designs, layouts and information about products, services and other content may not be copied or used without the written consent of Evess AB.

As a customer, you always agree that Evess AB has the right to use your social security number in order to register your purchase with the Transport Board and register you as the new owner of your electric moped.
2. contracts and orders
2.1
You must always accept the Terms and Conditions to make a purchase on our website. By accepting the terms and conditions, you thereby commit to comply with them in their entirety and you also agree that you have read and agreed to the handling of personal data and cookies.
2.2
A contract of sale has been made between you and Evess AB only when we have confirmed your order and you have received an order confirmation from us by email. We encourage you to keep your order confirmation for any future communication with our customer service department.
3 Prices, fees and payment
3.1
The prices on this website apply when you order on our website. Prices are in Swedish kronor and include VAT. Prices are all inclusive such as payment and shipping costs.
3.2
You can pay using the methods listed on this website. In case of invoice or installment payment, our partner may perform a credit check. We reserve the right not to always offer all payment methods or to change payment methods if the method you selected does not work for any reason at the time of purchase. Please note that restrictions on payment methods are indicated on this website.
4. Promotions and offers
4.1
We may from time to time run promotions on the Website which may involve more favorable terms than these Terms, e.g. regarding payment or extended cancellation rights. These more favorable terms apply while the promotion is active and to the specific products specified by us in connection with the promotion. We reserve the right to withdraw promotions at any time. If the promotion ends, these terms and conditions will apply. Offers for specific products on this website are valid for a limited time and subject to stock availability.
5. Delivery and transportation
5.1
Products in stock are usually delivered within 2-4 working days.
5.2
The expected delivery time of a product is displayed when you check out and/or on the relevant product page.
6. right to cancel / return
6.1
When purchasing products on Evess.se, it is always subject to a 30-day right of withdrawal / return under current consumer protection legislation. This means that you have the right to cancel your purchase by notifying us of this within 30 days from the time you or your agent received the ordered product.
6.2
The right to cancel does not apply to used products. For electric mopeds, we make an exception as we want to give you as a customer the opportunity to test the moped at home. This applies to a maximum of 50 km.
6.3
If you want to cancel a purchase, you must send us written notice by email before the end of the cooling-off period. You must provide your personal identification number, name, address and other information, such as the order number, invoice number and name of the product.
6.4
When you exercise your right to cancel, you pay return transportation and are responsible for the condition of the product after you receive it up to and during the return transportation. The product must be returned within 30 days of sending the notice of withdrawal to us. The product must be sent well packaged, in excellent condition and in its original packaging. Price example for return: Small package: 200 SEK.
Pallet truck (for example, vehicles and large accessories): Electric mopeds SEK 1500.
Upon delivery to you, transportation is at our risk, i.e. we are responsible for any damage to the product between our warehouse until you have received your product. You, in turn, are responsible for this if you return the product. When returning or exchanging a product, please make sure you include enough information to facilitate our processing. Include your name, social security number and telephone number as well as the order number.
6.5
When you cancel your purchase, we will refund the amount you paid for the Product. From the refunded amount, we are entitled to deduct an amount corresponding to the depreciation of the product from its original value if and to the extent that such depreciation is due to your handling of the product beyond what is necessary to establish its characteristics or whether it functioned as it should.
6.6
We will refund the amount as soon as possible and within 30 days from the date we received the product.
7. Warranty and notification of non-conformity
7.1
The warranty for products only covers original manufacturing defects and not defects that arise in connection with or following a change in the function and appearance of the product, e.g. rebuilding, upgrading or other configuration of the product. The product must also be used and cared for in accordance with the guides we have on the site for the warranty to be covered. Your order confirmation is your proof of warranty. Different products have different warranty periods.
7.2
Your right to notify non-conformity applies to products that are defective under applicable consumer protection legislation. Customers wishing to claim for defects in products ordered must contact us as soon as possible after the defect is discovered using the contact details provided on the website. Notifications of non-conformity given within 2 months of discovering the defect are always considered to have been submitted in time. You have a three-year right to notify non-conformity for products purchased on this website. You should always give notice of non-conformity as soon as possible to be sure that you do not lose your rights.
7.3
The specifications given for each product are always based on ideal conditions. We therefore reserve the right to any deviations in these. We also reserve the right to any misspellings or minor discrepancies in pictures of our products.
7.4
We will always pay for the return once the discrepancy notice has been accepted.
7.5
Once a product has been returned and the conformity notification accepted, we will compensate you under the terms of the applicable consumer protection legislation. Our aim is to do this within 30 days of receipt of the non-conformity notice, although it may take longer depending on the product in question. We reserve the right to reject a non-conformity notification if it turns out that the product is not defective under the terms of the applicable consumer protection legislation. 8. force majeure
We are not liable for delays caused by circumstances beyond our control such as general labor disputes, epidemics, war, fire, lightning, terrorist attack, changes in government regulations, technical problems, failures in electrical/telecommunications/data connections or other communications and failures or delays in services by subcontractors due to these circumstances. These circumstances constitute force majeure that relieves us of damages and other consequences. If such a situation occurs, we will notify you both at the beginning and at the end of this circumstance. If such circumstance lasts for more than two months, you and we have the right to cancel the purchase.
9. Changes to the conditions
We reserve the right to change these terms and conditions at any time. Any changes to these terms will be posted on this website. Changes will take effect when you accept the terms and conditions in connection with a purchase or when you visit the website or 30 days after we notify you of these changes. We recommend that you check the website regularly so that you are aware of any changes to these terms.
10. Applicable law and disputes

An attempt should always be made to resolve disputes through discussion with our customer service department. In the event of a dispute, we always follow the decisions of the Swedish Consumer Agency.
10.2
Disputes concerning the conduct or application of the Terms and Conditions must be interpreted in accordance with Swedish law and settled by ARN or ultimately by the public court.
